By reserving a charter or using our Service, you consent to these Terms. If you do not agree with any section of these terms, then you are not permitted to use the Service.
2. Service Overview
EquitableAccessCenter offers deluxe yacht chartering services, which include:
- Day-long yacht rentals
- Evening cruises
- Corporate outings
- Exclusive gatherings
- Extended charters
Our services are contingent upon availability and climate conditions. We retain the authority to change or halt services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservations, you need to:
- Have a minimum age of 18 years
- Supply accurate and thorough information
- Remit the required down payment as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is only assured after the payment is received and we send a written confirmation. We retain the right to reject service at our own judgment.
3.3 Availability
Charters depend on the accessibility of the vessel and favorable weather conditions. We will attempt to cater to your preferred schedule whenever feasible.
4. Payment Terms
4.1 Pricing
All prices are provided in € and incorporate all relevant taxes unless indicated otherwise. Prices are susceptible to changes without prior notification.
4.2 Payment Schedule
- Deposit: A payment of 50% of the total charter cost is due at the time of booking
- Final payment: Due 48 hours before the charter commences
- Any additional fees (if applicable): Payable at the end of the charter
4.3 Payment Methods
We accept various major credit cards, bank transfers, and certified cheques. All payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Entire amount refunded, less processing fees
- If canceled between 24 to 72 hours before departure: A 50% refund of the total cost
- For cancellations less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
Should the weather be deemed unsafe by our captain, we may offer to:
- Reschedule the charter to another suitable date at no extra charge
- Issue a complete refund if a reschedule is not possible
5.3 Mechanical Issues
In case of mechanical failures with the designated vessel, we will try to arrange an appropriate substitute. Should no replacement be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Adhere to all instructions from the crew
- Utilize safety equipment when stipulated
- Disclose any health conditions that could impact their safety
- Stay within the designated areas of the vessel
6.2 Prohibited Items
The following are not allowed on board:
- Glassware
- Illegal substances
- Weapons of any kind
- Excessive quantities of beverages (more than modest consumption)
- Pets (with exceptions for those pre-approved)
6.3 Conduct
Passengers are expected to behave respectfully. We retain the right to end a charter prematurely with no refund if a passenger's behavior endangers safety or negatively affects other guests.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the payment you made for the charter. We are not liable for:
- Personal injury due to passenger misconduct
- The loss or harm to personal belongings
- Indirect, resultant, or punitive damages
- Delays caused by weather or situations beyond our influence
7.2 Insurance Coverage
We hold comprehensive insurance for our vessels and operation. Customers are suggested to have their personal travel and property insurance.
7.3 Assumption of Risk
By taking part in our charter services, you recognize that maritime activities come with inherent risks and you accept the accountability for your personal security and well-being.
8. Modifications and Itinerary Changes
We reserve the authority to change itineraries, paths, or schedules because of weather elements, safety considerations, or operational criteria. We aim to ensure comparable alternative experiences where necessary.
9. Force Majeure
We shall not be held accountable for any delays, cancellations, or changes induced by events beyond our control, including but not limited to:
- Severe weather disturbances
- Natural disasters
- Regulations by the government
- Terminal shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your private details are treated in accordance with our Privacy Policy. In utilizing our services, you grant permission for the gathering and usage of your data as detailed in our Privacy Policy.
11. Intellectual Property
Content on our website, such as text, visuals, logos, and pictures, is shielded by copyright and intellectual property regulations. Reproduction, distribution, or creation of works based on the content is not permitted without our explicit consent.
12. Governing Law
The laws in Germany will govern these Terms. Any disputes will be settled in the jurisdictions located within Hamburg, Germany.
13. Changes to Terms
